Hereinafter “Musical Mastia”.

1. Acceptance of the General Contract Conditions

Hiring any of the Musical Mastia services implies acceptance as a Consumer, without reservations of any kind, of each and every one of the General Contract Conditions.

These General Contracting Conditions have been prepared in accordance with the provisions of Law 34/2002, on Services of the Information Society and Electronic Commerce, Law 7/1998 on General Contracting Conditions, Royal Decree 1906/1999 which regulates Telephone or Electronic Contracting with General Conditions in development of article 5.3 of Law 7/1998, Royal Legislative Decree 1/2007 which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws and Law 7/1996 on Retail Trade.

Musical Mastia may at any time and without prior notice, modify these General Conditions of Contract as well as the Particular Conditions that are included, by publishing said modifications so that they can be known. These new conditions do not require acceptance by contracts prior to the date of publication.

All communication about any of the services must be made in writing, to ensure the correct understanding of the message and not leaving it free to interpret, this being clear and precise.

2. Information prior to contracting

The Consumer declares to know and also accept the General Contract Conditions that are listed below, as well as any others of a particular or specific nature that could be established for the contract with Musical Mastia and that will be duly indicated.

3. Contract prices and other additional services

Musical Mastia will always and individually budget the services that the Consumer can opt for together with their own characteristics and their price. Likewise, Musical Mastia may make specific services available to the Consumer in each case.

The prices will be indicated in Euros (except for notified exceptions).

The prices are indicated without VAT, being this applicable of 21%.

In this way, Musical Mastia may at any time add new products and services to those offered, which will be governed by the provisions of the General Contract Conditions in force at that time.

The validity of the budgets will be 5 business days, and the cost of the included services can be modified without prior notice.

4. Form of payment and modalities

Payment for products or services will always be made in advance (at the value date), making a reservation at the time of contracting and the remainder will be paid between 30 and 15 days before the service is performed.

The amount delivered in reserve or signal, will never be refundable nor can it be transferred to another product different from the one initially contracted Art 1454 Civil Code.

The service will be carried out according to the details provided by the contracting party (time, place, etc…), Musical Mastia not being responsible for errors or omissions on its part.

The information of the service data must always be in writing or by e-mail.

The services are not considered “CONTRACTED”, until the reservation of the payment or signal of the same is made, leaving the product free for other consumers.

The contracted services will only allow a maximum change of 1 time on the date of the same (it could entail expenses and a price increase), after which the amount delivered as a reservation would be lost in its entirety.

5. Others

All the information provided during the contracting process will be stored by Musical Mastia so that the Consumer may, upon request made by e-mail, request information regarding the queries made by him within the previous 6 months.

It is imperative to provide the musicians or components with a shadow by any means for themselves, their instruments and elements that are necessary for the realization of the event, considering the term “Shadow” as a point or place where they are not exposed to direct light or indirect sunlight or artificial light, which may cause problems or damage to them or related items. In the same way applicable to climatic conditions not suitable for the correct development of the event.

All the means and technical requirements (sound equipment, chairs, umbrellas, etc…) that are required to perform the service, will be paid by the Consumer, unless otherwise agreed, as well as the expenses or taxes to which the provision of such services may give rise to Being detailed all this information in writing or e-mail.

Maximum standard performance times: Ceremony and Cocktail 1 hour – Banquet 2 hours – Open bar 1 hour – Various events 1 hour, all these times must be consulted for confirmation, it is essential.

The audio or video recording in any type of medium or device during any of our services is not allowed, therefore it must be informed and consulted, for its acceptance and authorization in writing.

The Consumer must follow all the indications and instructions given by Musical Mastia, being possible the cancellation or postponement of the same if these were not fulfilled.

The songs that are part of the “to play” repertoire must be known to Musical Mastia, in a written and clear manner (using the Song Choice form), with a minimum of 30 calendar days before the date of the event. Otherwise, Musical Mastia may select the repertoire that best suits it, this being final and without the possibility of being modified without prior notice.

Any song or moment that is outside of our model repertoire, published on the web https://www.musicalmastia.es/canciones/, could have an additional cost for its preparation and arrangement, as long as it is within a time and form determined by Musical Mastia.

In the event of a delay by the customer in the start of the service, he should pay for each member of the training (including technicians and carriers) €60 per hour, €30 per half-hour delay from the reported start time.

The client authorizes Musical Mastia to record or photograph the event for its subsequent broadcast in any medium, either deferred or live through any present or future multimedia device.

The default piano will be a professional 88-key keyboard, with the grand or tail piano always being extras subject to contracting.

6. Withdrawal from the contract

We inform you that, once the object of the contract is received, and the reservation is made, it is not possible to refund the amount paid.

Only under force majeure will it be allowed to postpone the reservation to future dates, always at the discretion of Musical Mastia.

7. Replacement or cancellation

If for reasons of force majeure the service contracted by Musical Mastia could not be carried out in its entirety or in part, the change would be made for an equal or similar service (according to availability to date) or the partial or complete.

In case of canceling the service with a date less than 30 days before the date of the event, the amount delivered will not be refundable in any case, and full payment of the contracted service is also necessary.

If, due to lack of time or the impossibility of contacting, the consumer could not be informed sufficiently in advance, Musical Mastia would make the necessary changes to the service immediately without the need for its approval, always acting in good faith.

The total or partial refund will always be the final decision of Musical Mastia, leaving the consumer released from it.

In the event that any person or entity, outside of Musical Mastia, damages, rebukes, disrespects or performs any type of degrading and illegal action that endangers the event, the members or the material used in it. Musical Mastia will cancel the action at that moment, informing the contracting party as much as possible and the latter being responsible for the damages and expenses that may be caused. No possibility of refund of the amount paid.

8. Suspension or Postponement

Musical Mastia is not responsible for causes beyond its control, such as: weather conditions, catastrophes, illness, death, pandemics, earthquake, tsunami, plague, etc…

In the event of a change in the date, time or place of the contracted service, Musical Mastia cannot guarantee its availability.

9. Legislation and applicable jurisdiction

These conditions will be governed by Spanish legislation, which will apply to what is not provided in these conditions in terms of interpretation, validity and execution.

The parties, waiving any jurisdiction that may correspond to them, expressly submit and to the extent that the applicable legislation allows it, to the Courts and Tribunals of the city of Murcia to resolve any controversy that may arise in the interpretation or execution of the present contractual conditions.

10. Data Protection

In accordance with the provisions of Organic Law 15/1999, of December 13, Protection of Personal Data (LOPD), we inform you that your data will be incorporated into a file owned by Musical Mastia in order to carry out administrative, accounting and fiscal management, as well as sending you commercial communications about our products and/or services that may be of interest to you.

Likewise, we inform you of the possibility of exercising the rights of access, rectification, cancellation and opposition of your data at the fiscal address of Apartado de Correos 261 – 30100 located in: Espinardo (Murcia).

SPECIFIC CONDITIONS OF THE SONG SELECTION SYSTEM

“Choose Your Songs” is a system created to facilitate communication between clients and Musical Mastia in the “Choice of Songs” phase, which are essential for the performance of the service, in this way you can choose each of the necessary moments, accompanied by the exact song without the possibility of error, clearly and with a copy of the same for both parties.

Moment: It is necessary to confirm that the moment itself exists, since depending on the contracted service, it may be excluded.
Song: The list of songs within the repertoire is included in the dropdown, any song that does not exist in the default repertoire must be selected with the option :: ANOTHER SONG? :: .

If you chose the option :: ANOTHER SONG? ::, it is necessary to previously consult with Musical Mastia the possibility of carrying it out, in addition to whether it had or had added costs. Choosing the option :: ANOTHER SONG ? :: unilaterally and without prior consultation, it does not imply in any case that said song can be performed.

Due to the anti SPAM filters of the most important email providers (yahoo, google, hotmail, etc…) in most cases, the copy of it usually reaches the “Unwanted” folder or “Spam” emails. (junk), please check those folders.

The data requested from the user in the forms on the website will be mandatory unless otherwise indicated in the corresponding form.

In the event that the user does not provide the mandatory data requested, Musical Mastia will not be able to process the contracted service correctly. having a period of 24 hours to always communicate by written means (email, text message, whatapp, etc…) the modification thereof.

The personal data subject to treatment will be kept throughout the application or request for information process, or failing that, during the periods established in current legislation, proceeding to be canceled when they are no longer necessary or relevant for the purpose for which have been collected or recorded. In this regard, it specifies that the cancellation does not imply the deletion of the data, but rather its blocking. As long as the data is blocked, its treatment will be prevented and it will be kept only at the disposal of the Public Administrations, Judges and Courts for the attention of the possible responsibilities arising from the treatment, as long as the limitation periods of the responsibilities elapse.

Musical Mastia, undertakes, in the use of the data included in the file, to respect its confidentiality and to use it in accordance with the purpose of the file, as well as to comply with its obligation to save it and adopt all the pertinent measures to avoid the alteration, loss, treatment or unauthorized access, in accordance with the provisions of the regulations on the Protection of Personal Data.

In the event that the request must include personal data, referring to natural persons other than the one making it, the user must, prior to its inclusion, inform them of the content of this clause, in accordance with the provisions of the Data Protection Law.

The interested party or his legal representative may exercise the rights of access, rectification, cancellation, opposition, limitation and/or portability of his personal data at any time, in writing, accompanied by a copy of the official document that identifies him and, where appropriate. , of the person representing him, addressed to Musical Mastia, PO Box 261, 30100, Espinardo, Murcia. The interested party may file a claim with the Spanish Agency for Data Protection when he considers that his rights or the processing of his data have not been addressed or in accordance with current legislation on the protection of personal data.

The data requested from you is necessary and essential, so that if you do not provide it, the provision of the required service will not be possible or it may even be provided incorrectly due to omission of information or errors in them, in this sense, through the indication of your data and the acceptance of these legal conditions, we will understand that your consent has been granted.

The interested party may withdraw the consent of the treatments described above at any time, by writing to the person responsible for the file in the terms described in this text for the exercise of rights.
